WHAT IS CHAPTER 7 BANKRUPTCY?
Chapter 7 is the most actively pursued filing for individuals facing debt control problems. In today's consumer based economy, more and more people are faced with insurmountable debts. Chapter 7 allows a person to eliminate those debts while still being able to keep their home and or vehicle provided that the payments are made current and up to date.

Chapter 7 eliminates the following debts:
• Lawsuit debts
• Credit card debts
• Medical debts
• Personal loan debts
• Deficiency debts on repossessed autos and foreclosures
• Personal injury debts
• Other exceptions and conditions may apply.

While Chapter 7 bankruptcy does eliminate debt, it does not eliminate all debts. Debts that are not dismissible are:
• Student loans (except hardship cases)
• Debts from certain taxes
• Alimony
• Child support
• Fines
• Penalties and criminal restitution
• Debts incurred from fraudulent conduct
• Personal injuries caused while driving intoxicated.



 

WHAT IS CHAPTER 13 BANKRUPTCY?
Chapter 13 bankruptcy gives an individual the freedom to consolidate their debt while affording them the opportunity to make convenient monthly payments to a trustee. The trustee will set a repayment plan, which will repay the debt over a 3 to 5 year period. The repayment period and payment amounts are figured on the following criteria:
• Amount of the debt
• Nature of the debt
• Monthly income of the debtor
• Monthly expenses of the debtor.

Most commonly, Chapter 13 involves repaying mortgage arrears on homes and restructuring auto loans to save a vehicle. On these, secured debts are paid back 100% on the dollar and unsecured debts may be paid less than 100% on the dollar. A discharge is given once the preset payment plan is paid and completed.



 

SHOULD I FILE FOR BANKRUPTCY?
Most people have the perception that bankruptcy is the last resort on a dead end street. Actually, bankruptcy is and can be the beginning to brand new start. Sometimes because of circumstances beyond their own control, good people find themselves in bad situations. Death of a family member, serious illness, or a permanent loss of a job can send someone in a fast and bottomless spiral. Filing bankruptcy can give you the opportunity to stop the bleeding and regain control of your life.
